The Two Federal Laws That Protect Every ESA Owner in America
These two federal laws establish the baseline rights for ESA owners across all 50 states:
Fair Housing Act
Requires housing providers to make reasonable accommodations for individuals with disabilities, including allowing emotional support animals - even in no-pet buildings. Applies to most housing types including apartments, condos, co-ops, and rental homes. Landlords cannot charge pet fees for ESAs.
Americans with Disabilities Act
The ADA governs Psychiatric Service Dogs (PSDs) - not emotional support animals. ESAs do not have public access rights under the ADA. However, PSDs trained to perform specific tasks do have full public access rights. If you need public access rights, ask us about a PSD letter.
