ESA Laws by State - Federal Rights + State Protections Explained

Emotional support animal rights begin with two federal laws - the Fair Housing Act and the ADA - but many states have layered on additional protections. Find out exactly which laws apply where you live, what landlords must do, and what no-pet policies can't override.

The Two Federal Laws That Protect Every ESA Owner in America

These two federal laws establish the baseline rights for ESA owners across all 50 states:

FHA

Fair Housing Act

Requires housing providers to make reasonable accommodations for individuals with disabilities, including allowing emotional support animals - even in no-pet buildings. Applies to most housing types including apartments, condos, co-ops, and rental homes. Landlords cannot charge pet fees for ESAs.

ADA

Americans with Disabilities Act

The ADA governs Psychiatric Service Dogs (PSDs) - not emotional support animals. ESAs do not have public access rights under the ADA. However, PSDs trained to perform specific tasks do have full public access rights. If you need public access rights, learn about our PSD letter.
