Please read these Terms of Use carefully before using The Supportive Pet's website or services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and The Supportive Pet Inc. ("The Supportive Pet," "we," "us," or "our"). By creating an account, submitting an intake form, making a payment, or otherwise using our website or services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Our Services
The Supportive Pet is a platform that connects individuals seeking Emotional Support Animal (ESA) letters and Psychiatric Service Dog (PSD) letters with licensed mental health professionals (LMHPs). Our services include:
- Online intake and evaluation forms
- Matching with state-licensed LMHPs
- Issuance of ESA and/or PSD letters where clinically appropriate
- Landlord and housing verification support
- Annual letter renewal services
The Supportive Pet is not a healthcare provider, medical practice, or law firm. We are a technology platform. All clinical evaluations are conducted independently by licensed clinicians. The letters we facilitate are clinical assessments, not legal documents issued by The Supportive Pet.
3. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Provide truthful, accurate, and complete information on your intake form
- Not be using our services for any fraudulent or unlawful purpose
By using our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts and refuse service to anyone who provides false information or violates these Terms.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and current information when creating your account
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with any third party
- Not create multiple accounts to circumvent a denial or ban
5. Payment & Fees
Fees for our services are displayed prior to checkout. By submitting payment information, you authorize us to charge the applicable fees upon completion of your evaluation and issuance of your letter. Please review our Refund Policy for full details on charges and refunds.
All fees are in U.S. dollars. We use secure third-party payment processors and do not store full payment card information on our servers.
6. No Guarantee of Outcome
An ESA or PSD letter is issued only when a licensed clinician independently determines that it is clinically appropriate based on your evaluation. The Supportive Pet does not guarantee that you will qualify for or receive a letter. If the clinician determines a letter is not clinically appropriate, you will not be charged (see our Refund Policy).
Furthermore, The Supportive Pet does not guarantee that any letter issued through our platform will be accepted by any landlord, housing provider, airline, or other third party. Third-party acceptance decisions are outside our control.
7. Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information on any intake or evaluation form
- Obtain an ESA or PSD letter for an animal that is not your own or for fraudulent purposes
- Misrepresent the nature or status of your animal to any third party using a letter from our platform
- Use our services in violation of any applicable law, including the Fair Housing Act or the Americans with Disabilities Act
- Attempt to circumvent, disable, or interfere with security features of our website
- Scrape, copy, or republish any content from our platform without written permission
- Engage in any conduct that could damage our reputation or the integrity of the ESA/PSD letter industry
Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.
8. Intellectual Property
All content on our website - including text, graphics, logos, images, and software - is the property of The Supportive Pet Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
ESA and PSD letters issued by licensed clinicians through our platform are clinical documents. You may use them for their intended purpose (housing, travel accommodations) but may not alter, forge, or misrepresent them.
9. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
The Supportive Pet does not provide legal or medical advice. Nothing on our website constitutes legal counsel or establishes a clinician-patient relationship with The Supportive Pet (though a relationship may exist between you and the independent licensed clinician conducting your evaluation).
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPPORTIVEPET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising from your use of the services shall not exceed the amount you paid to The Supportive Pet in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Supportive Pet Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States without regard to conflict of law principles. Any disputes arising under these Terms shall first be submitted to informal negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where appropriate, notify you by email. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
